ACU settles spectator's damages claim

A damages claim by a spectator injured in crash in the 2013 TT has been settled out of court.

Judith Clapton, from Norwich, had lodged a personal injuries claim for up to £100,000 against the Auto Cycle Union Ltd.

She was among a crowd of spectators watching the Senior race from the bottom of Bray Hill when a rider crashed, sending debris flying.

Her civil court damages claim was due to be heard over two days this month, just as the island entered into a second lockdown.

But the court has confirmed: ’This matter has now been settled and no future dates are required.’

Ten people were taken to hospital, a number of them with limb injuries, following the 2013 Bray Hill crash.

Ms Clapton suffered serious lower limb injuries and serious injury to her hand and upper limb.

She also had various other cuts and bruises and claims to have suffered post traumatic stress disorder and had to be off work for a time.

Ms Clapton was seeking damages of between £50,000 and £100,000 for personal injuries suffered and losses and expenses incurred.

She argued this was the consequence ’of the negligence and/or breach of duty’ of the ACU in the ’organisation, management and performance’ of the TT race.

Her claim form was lodged back in May 2016 but the case had been due to be heard before Deemster John Needham on January 6 and 7.

The Bray Hill crash took place on June 7, 2013 when Barnsley rider Jonathan Howarth, crashed on the fast downhill section on the opening lap of the 2013 Senior race.

Howarth sustained a minor fracture.

Other spectators have lodged claims for damages.

Company director Shaun Williams and his wife Helen, of Gloucestershire, are also due to have their personal injuries claim heard in court this year.

The ACU has already admitted liability in relation to the Williams’ claims for damages.

Mr Williams, 57, suffered severe lower limb injuries and is seeking damages of between £150,000 and £200,000 for medical treatment, psychological trauma and loss of earnings. His wife suffered minor lower limb injuries.

She is claiming up to £100,000 for psychological trauma and loss of earnings.

Their case is not currently listed for a hearing but is expected to be heard between April and July.
